“Murder Trial Halted: Errors by Crown Attorneys Free Accused”

In a rare turn of events, a Superior Court justice has halted a murder trial in Hamilton due to critical errors made by two Crown attorneys. The decision led to a judicial stay, freeing the accused, Salomon Bashir, from facing trial for the second-degree murder charge he was facing in the death of Everton Frost.

Justice Giulia Gambacorta deemed the conduct of assistant Crown attorneys Michael Dean and Steve Kim, along with Hamilton police, as negligent and lacking the necessary diligence, thereby compromising Bashir’s right to a fair trial. The failure to disclose crucial DNA and cellphone tower evidence to the defense before the trial was cited as key missteps.

The initial arrest of Bashir in connection with Frost’s shooting death in December 2022 led to the discovery of DNA evidence on a surgical mask believed to be linked to the crime. Despite the police possessing this critical evidence, it was not shared promptly with the Crown’s office or the defense team, causing a delay in the disclosure process.

Additionally, the Crown failed to inform the defense about the use of cellphone tower data and the involvement of expert witnesses until the trial was set to begin. These oversights prompted the defense to seek a stay of the proceedings, a move that was ultimately granted by Justice Gambacorta.

The decision to stay the trial was significant, particularly given the lengthy pretrial custody Bashir had already experienced. The defense highlighted the need to preserve the integrity of the judicial system and ensure fair trial rights for all individuals involved.

This ruling marks a rare occurrence in Ontario, with defense lawyers expressing concerns over the lack of accountability shown by the Crown’s office in addressing the issues that led to the trial’s halt. The Ministry of the Attorney General has yet to comment on any measures taken to prevent similar incidents in the future, leaving questions about the handling of such cases unanswered.
