ICJ Rules Israel Must Allow UN Aid to Gaza

The International Court of Justice (ICJ) ruled on Wednesday that Israel must permit the United Nations Relief and Works Agency (UNRWA) to deliver humanitarian aid to Gaza, which is facing severe conflict-related challenges. The ICJ’s decision came in response to a request for an advisory opinion from the UN General Assembly regarding Israel’s actions in banning UNRWA, the primary aid provider in Gaza, from operating in the region.

According to ICJ President Yuji Iwasawa, Israel is obligated to allow and facilitate relief efforts by the United Nations and its agencies, including UNRWA. Israel has refuted accusations of breaching international law, criticizing the court’s proceedings as biased. Despite not participating in the hearings, Israel submitted a 38-page document for the court’s review.

The outcome of this case is anticipated to have significant legal implications, potentially affecting UN operations globally. Israel’s rejection of the ICJ’s advisory opinion was emphasized by the country’s Foreign Affairs Ministry on social media, asserting its commitment to international law. Israeli Ambassador to the UN, Danny Danon, denounced the opinion as “shameful” and criticized the UN for alleged ties to terrorist groups.

The ongoing fragile ceasefire in Gaza, brokered by the US and effective since October 10, has faced recent challenges following deadly incidents. Under the agreement, a daily allowance of 600 humanitarian aid trucks is permitted to enter Gaza. Hamas officials have confirmed Israel’s compliance with aid deliveries as stipulated in the ceasefire terms. The UN has announced intentions to increase aid shipments to Gaza to alleviate the humanitarian crisis.

Israel’s ban on UNRWA, instated in January, has drawn criticism from various quarters, including accusations of bias and political motivations. The impact of the ban has led to severe food shortages in Gaza, prompting international concern. While advisory opinions from the ICJ are non-binding, they hold weight in resolving disputes involving UN personnel.

Past ICJ advisories on Israeli policies have sparked controversy, with Israel contesting the court’s decisions. The court’s rulings on the legality of Israel’s actions in Palestinian territories have been met with both support and condemnation.
