This penalty, totaling $759,368.84, is the second-largest fine from WorkSafeBC to the B.C. government concerning safety lapses during the 2023 wildfire season. The severe wildfires of 2023, which ravaged over 2.8 million hectares and resulted in multiple first responder fatalities, marked a historic level of destruction in the province.
The tragic death of Zak Muise, a firefighter with Bigcat Wildfire, occurred on July 28, 2023, when his all-terrain vehicle overturned on a gravel road while combating the Donnie Creek wildfire near Fort St. John. WorkSafeBC highlighted safety deficiencies, such as the absence of a helmet and failure to use a passenger seatbelt or damaged retention netting. Despite the investigation, Mike Smesman, the owner of Bigcat Wildfire, expressed gratitude for the inquiry but mourned Muise’s loss, emphasizing the emotional toll on the company.
In a separate incident, five Brazilian firefighters were endangered by flames during a controlled burn in B.C.’s Shuswap region in August 2023. WorkSafeBC attributed the incident to inadequate planning, training, and communication, with the employer’s safety protocols not being fully adhered to. The Forests Ministry plans to seek a review of the penalty decision, expressing reservations about the bundling of unrelated penalties and emphasizing the importance of workplace safety compliance.
Forests Minister Ravi Parmar commended the dedication of wildland firefighters, acknowledging the risks they face daily. While WorkSafeBC bases penalty amounts on employer payroll size and violation severity, the province’s response to previous fines indicates a willingness to contest penalties deemed excessive. The regulatory body aims to enforce safety standards and prevent future tragedies by holding employers accountable for maintaining secure work environments.
